On Jan. 20, Biden to issue memo freezing Trump administration's midnight regulations

At noon ET on Jan. 20, after President-elect Joe Biden  inaugurated, he will issue a memo to stop or postpone midnight regulations and actions taken by the Trump administration that have not gone into effect by Inauguration Day, Biden transition spokeswoman Jen Psaki said Wednesday.

Midnight regulations are created by executive branch agencies during the lame duck period of an outgoing president's administration. Psaki shared some examples, including a rule the Department of Labor is expected to publish that "would make it easier for companies to call their workers independent contractors to avoid minimum wage and overtime protections."

Issuing a regulatory freeze is standard practice for incoming administrations, Psaki said, "but this freeze will apply not only to regulations but also guidance documents — documents that can have enormous consequences on the lives of the American people." Biden has already said he will take several executive actions on his first day in office, including rejoining both the World Health Organization and the Paris Agreement, an international treaty on climate change.

I was harassed, lock up and extorted by the police in aba

On 29/12/2020 in Aba, I was stopped by a group of police men while driving myself and family members on my 2005 honda accord. The police men wore just police camouflage polos with no displayed Identity card, name tag or force number and were carrying AK-47 rifles. I was driving my 2005 honda accord car with Lagos registration number.

Inside the car were my two younger brothers, my younger sister, my wife and my one year old baby. The police men requested for my vehicle papers and driver's license which I handed over to them. They said that my license registration number is fake. They showed me an FRSC web page where they ran my plate number and it displayed "Invalid".

I explained to them that the number was duly registered in Lagos and that the plate number was gotten via legal channels and there is no way it can be fake. They wouldn't hear of that. I demanded that they allow me call who registered the vehicle for me which I did. The agent that registered the vehicle for me is a colleague of mine in the office that has connection with FRSC.

He explained to me that Lagos is the only state that produces their plate number themselves and that sometimes they don't upload it on FRSC database. So, that the number doesn't show on FRSC database doesn't mean that it's fake. He gave me Lagos autoreg verification website(verify.autoreg.ng) to give the policemen to verify the plate number . I personally verified my number on the autoreg website and it showed valid. I tried explaining these to the policemen but they wouldn't hear the explanation.

They collected the car keys from me to drive the car to their station but couldn't start the car after several attempts. They ordered I and my younger brother into their miniature mitsubishi bus and took us to their station. They later took my brother back to the car location and towed the vehicle to their station.

They told me to UnCloth to my boxer shorts and detained me inside their cell(the condition of the cell is story for another day). I was detained for approximately 6hours till my dad came and they collected thirty thousand naira from him before releasing me. The DPO ordered for my release after my father intervened and is most likely aware of the thirty thousand that was paid before I was released.

He(DPO) said my vehicle should not be released till they conclude investigation on the license plate issue. They defrauded 30k from my father to effect my release when I committed no crime. My vehicle was duly registered in Lagos which can be verified on autoreg website. They detained me for no just cause for 6hours in a filthy cell that is not fit for lower animals let alone a human being. They refused to release my vehicle till this moment thereby causing a lot of hardship to my family for someone that visited home for Xmas.

I have resolved to fight the humiliation I am suffering in their hands with everything I have got. I just want to be sure that what my agent told me is the truth. Is a plate showing on autoreg but not on FRSC database fake? How can I prove that my plate number is authentic?

Please gurus should respond.

Forgery: Court Admits Two More Exhibits Against Obaseki

The Federal High Court sitting in Abuja, on Wednesday, admitted two more exhibits into evidence in the certificate forgery suit against Edo State Governor, Godwin Obaseki.

Recall that the court had on Tuesday admitted Obaseki’s nomination form into evidence. The nomination form, which enabled him participate in the September 19, 2020, governorship election was tendered by the Independent National Electoral Commission (INEC).

At the resumed hearing on Wednesday, an Associate Professor in the Department of Economics, University of Lagos, Emmanuel Balogun, appeared as the third principal witness (PW-3) in the case.

The witness tendered the original copy of his own degree certificate in Agricultural Economics, which was awarded to him on July 6, 1979, by the University of Ibadan. Obaseki had said he obtained a Bachelor of Arts degree in Classics from the same university in the same year.

On whether the governor’s certificate was forged, Balogun said he could not comment on it because he had not seen the certificate before.

Under cross-examination, the PW-3, told the court that he got admission into University of Ibadan in 1975 through prelim.

He said as of that time, there were students that were also admitted through direct entry, adding that while those that entered through prelim spent 4 years, those that got into the school through direct entry spent only 3 years.

Balogun noted that he would be surprised that “somebody can get admission into the University of Ibadan as at then with only three O’level results or two A level results with a minimum of 2 HSC papers.”

“As at 1976, there were different entry requirements for prelim and direct entry students,” the witness said.

“As at then, admission requirements varied from one faculty to the other. The basic requirement for admission was 5 credits, including Maths and English, but anyone coming in through direct entry must have made the 5 credits and then choose two subjects in HSC.

“Generally, a certificate is signed by the Vice Chancellor and the Registrar, with a date on it. Generally, all certificates issued by University of Ibadan are coloured with a coloured logo on it.

“The certificate is usually larger than the normal A4 papers.”

He stated that if any attempt is made to compress and photocopy a certificate in an A4 paper, some parts of the certificate would be left out and would no longer be a reflection of the original certificate.

The witness said he was subpoenaed by the plaintiffs on December 23 to produce the original copy of his degree certificate before the court.

The presiding judge, Justice Ahmed Mohammed, admitted his certificate into evidence and marked it as Exhibit PL-4.

After the original certificate was admitted into evidence, counsel to the plaintiffs, Akin Olujimi, SAN, applied to substitute it with the photocopy, arguing that the original document is very valuable and irreplaceable.

But Obaseki’s counsel, Ken Mozia, and that of the People’s Democratic Party (PDP), Razaq Isenalohme, opposed the request, insisting they would make use of the exhibit in the course of the hearing.

After the PW-3 completed his testimony and was discharged by the court, the plaintiffs produced a retired Assistant Superintendent of Police and a forensic document examiner, Mr. Raphael Onwuzuligbo, as their next witness.

Onwuzuligbo said he was in court on the strength of a subpoena that was also issued on him.

The subpoena was tendered into evidence and marked as Exhibit PL-5.

The defendants resisted an attempt by counsel to the plaintiffs to tender a document that contained report of investigation that was conducted by the witness.

The defendants argued that the document was neither pleaded nor in the court’s file, insisting that it did not qualify to be admitted as evidence in the case.

They noted that the document was made on November 16, during the pendency of the suit.

They further argued that the plaintiffs failed to establish the relevance of the document to the case.

The defendants, therefore, urged the court to reject the document.

Responding, the plaintiffs’ counsel urged the court to dismiss the objections and argued that a document that is needed to prove a fact does not need to be pleaded.

Olujimi said the report touched on Obaseki’s certificate that is in issue.

The report was admitted in evidence as Exhibit PL-6. However, the court held that it would consider objections against its admissibility in the final judgement.

Justice Mohammed, thereafter, adjourned the case till Thursday to enable the defendants to cross-examine the witness.

The APC and one of its members in Edo, Williams Edobor, had filed a suit marked FHC/B/CS/74/2020 against Obaseki in July 2020.

They alleged that the governor forged the University of Ibadan degree certificate he submitted to INEC in aid of his qualification for the election.

The plaintiffs equally alleged that there were discrepancies in the subjects that Obaseki claimed he passed in his West African Examination Council (WAEC) exam and subjects in his testimonial.

Consequently, they are praying the court to declare that his claim in his INEC form EC9 at column C, sworn to on June 29, 2020 at the Federal Capital Territory High Court Registry to the effect that he obtained from the University of Ibadan in 1979, a Bachelor of Arts Degree in Classical Studies, is false and contrary to Section 31 (5) and (6) of the Electoral Act, 2010.

Also, they are seeking an order declaring that Obaseki lied on oath when he swore to an affidavit on June 29, 2020 that he worked in Afrinvest Limited from 1994 to 2014 when he retired.

Obaseki defeated APC candidate, Osagie Ize-Iyamu, in the election to secure re-election.

Buhari asks CBN not to give forex for food import

Bolaji Ogundele, Abuja

PRESIDENT Muhammadu Buhari on Tuesday  reiterated his earlier directive to the Central Bank of Nigeria (CBN) not to  grant foreign exchange for food importation.

He also promised that his administration would from early next year  keep an eye on the rising cost of foodstuff in the country.

The President, who had last September said  ”nobody importing food should be given money,” also stated that diversification from oil to agriculture saved  Nigeria from the harsh economic realities of COVID-19.

He spoke during his  fifth   meeting with the Presidential Economic Advisory Council at the State House, Abuja yesterday.

Buhari, according to a statement   by his  Senior Special Assistant on Media and Publicity, Mallam Garba Shehu, said  since seven states produce enough rice that the nation needs, it made no sense to import food.

“The CBN must not give money to import food. Already, about seven states are producing all the rice we need. We must eat what we produce,” he stated. The  President had in September explained that  Nigeria which hitherto had only three fertilizer blending plants now has 33.

In taking note of the strides made in agricultural production through  diversification,    Buhari wondered where the country would have been  by now that COVID-19  was ravaging the global economy.

He said: “Going back to the land is the way out. We depended on petrol at the expense of agriculture. Now, the oil industry is in turmoil. We are being squeezed to produce at 1.5 million barrels a day as against a capacity to produce 2.3 million. At the same time, the technical cost of our production per barrel is high, compared to the Middle East production cost.”

The President emphasised the place of agriculture in the efforts to restore the economy but agreed that measures must be put in place to curtail inflation in the country:

His words: “We will continue to encourage our people to go back to the land. Our elite is indoctrinated in the idea that we are rich in oil, leaving the land for the city for oil riches. We are back to the land now.

“We must not lose the opportunity to make life easier for our people. Imagine what would have happened if we didn’t encourage agriculture and closed the borders. We would have been in trouble.”

The meeting, which was for a review of  and reflections on the global and domestic economy in the outgoing year was attended by  Vice-President  Yemi Osinbajo, as well as Ministers of Finance, Zainab  Ahmed and her  Humanitarian Affairs counterpart Sadiya  Farouk.

The meeting  noted as follows:

the sharp deterioration in international economic environment and its impact on Nigeria’s continuing but fragile economic recovery;

that Nigeria’s economic growth continues to be constrained by obvious challenges, including infrastructural deficiencies and limited resources for government financing; and

the need to make the private sector of the economy the primary source of investment, rather than government.

The meeting reviewed progress towards structural reforms in response to the economic crises, including the institution of the Economic Sustainability Plan, the changes in electricity tariffs and fuel pricing regime, the partial re-opening of the nation’s  land borders, the movement towards unification of exchange rates and budgetary reforms through Finance Bill 2020 and 2021.

It also  agreed that, to prepare the country for the challenges ahead, it is imperative to ensure macro-economic stability, create certainty and re-build investor confidence in the economy.

The meeting emphasised the need to deepen structural reforms initiated by the  Buhari administration as a basis for stimulating investments from domestic and international sources with a view to raising productivity in key sectors of the economy.

Nigeria maintained its lead as the biggest economy in Africa

The international Monetary Fund (IMF) has said that Nigeria maintained its lead as the biggest economy in Africa, in terms of the size of the country's Gross Domestic products (GDP).

But globally, the IMF, in its recently released world Economic Outlook (WEO), reviewed by Thisday  yesterday, ranked Nigeria the 26th largest economy, with the average GDP of $442.976 billion.

The computation was based on nominal GDP, which does not take into account difference in the cost of living in different countries.

The IMF, recently returned a gloomy verdict on the Nigeria economy for 2020, declaring that the nation's economic outlook was challenging.

The multilateral institution, in its recently released 2020 Article IV consultation on Nigeria, had stated that the country's economy "is buffeted" from side to side by a cocktail of issue, including the uncertainty over the COVID-19 pandemic, low oil price, capital outflows and balance of payment challenges"

The IMF had stated " The COVID- 19 global pandemic is exciting a heavy toll on the Nigerian economy, which was already experiencing falling per capital income and double digit inflation, with limited buffers and structural bottlenecks.

"Low oil price and sharp capital outflows have significantly increased balance of payment (BOP) pressures and, together with the pandemic-related lockdown, have led to a large output contraction and increased unemployment."

In its estimation, the IMF said supply shortages have pushed up headline inflation to a 30-month high.

It said " under current policies, the outlook is challenging. Real GDP is projected to contract by 3¼ per cent in 2020. The recovery is projected to start in 2021, with subdued growth of 1½per cent and the output recovery to its pre-pandemic level only n 2022."

The IMF report which acknowledged the efforts of the central Bank of Nigeria (CBN) to rein in inflation, however, maintained that despite an expected easing of food prices, inflation projected to remain in double digits and above the CBN's target range.

"Following a significant decline in revenue collections - from levels that were already among the lowest in the world- fiscal deficits are projected to remain elevated in the medium terms," the report stated.

Recognizing various policy measures put in  Place by the federal government, the Bretton wood institution still believes There is need to put in place more broad market reforms in order to address pressing balance of payment pressure in Nigeria.
